Terms of Service
These terms govern your use of Gooingto (gooingto.com), a service that lets small businesses publish a booking page and receive appointment requests that are confirmed over WhatsApp. By creating an account or using the service you agree to them. If you do not agree, do not use Gooingto.
1. Who we are
Gooingto is operated by Gad Lopez Alvarez, tax ID 305465181, with address at Kote Marjanishvili St. N 49, Chugureti district, Tbilisi, Georgia ("Gooingto", "we", "us"). Contact: [email protected]. Other contact addresses are listed in the Legal notice.
2. The service
We provide a public booking page under gooingto.com/your-business, an admin panel, and tools to manage availability, professionals and bookings. There are three kinds of people involved: you (the business that opens an account), your clients (who use your public page to request appointments), and us. Bookings are agreements between you and your clients. Gooingto is not a party to them and does not process payments between you and your clients.
3. Eligibility and accounts
- You must be at least 18 years old and act on behalf of a business or as a self-employed professional.
- You must provide a valid email address, keep your password and PIN confidential and tell us at once if you suspect unauthorised access.
- You are responsible for everything that happens under your account and for the accuracy of what you publish (business name, photos, address, phone numbers, opening hours).
4. Plans, trial and payments
New accounts start with a free trial of 30 days with all features included, without a payment card. After the trial the account continues on the free plan (1 professional, up to 20 bookings per month, Gooingto branding, basic styles) unless you subscribe to a paid plan. The plans and prices in force are those shown in the pricing section of gooingto.com and in your panel.
Georgia. Paid plans are not offered in Georgia. Accounts registered with a Georgian phone number (+995) are limited to the free "Georgia" plan: 1 professional and up to 10 bookings per month, with Gooingto branding and no free trial of paid features. Registering a phone number from another country to avoid this limit is a breach of these terms and we may suspend the account.
- Paid plans are billed in advance, monthly or yearly, and renew automatically until cancelled.
- Prices may not include applicable taxes, which are calculated at checkout according to your location.
- We may change prices with at least 30 days' notice; the change applies from your next renewal.
- Payments are handled by Paddle.com Market Limited ("Paddle"), which acts as the merchant of record: it sells the subscription to you, collects the payment, applies taxes and issues the invoice. Paddle's buyer terms apply to the purchase. We never see or store your card details.
5. Changing plan and cancelling
- Upgrades (a higher plan, or moving the same plan from monthly to yearly) take effect immediately, and the price difference is charged pro rata for the rest of the current period. Downgrades take effect at the end of the period you have already paid for; until then you keep your current plan, and you can cancel a scheduled change from your panel while it has not yet been sent to our payment provider.
- You can cancel a paid plan at any time. It stays active until the end of the period you already paid for, and then the account moves to the free plan.
- If your plan allows fewer professionals than you have, you must remove the extra ones before the change can apply.
- You can delete your account at any time by writing to [email protected].
Refunds are covered by our Refund Policy.
6. Acceptable use
You may not use Gooingto to: break the law; send spam or unsolicited messages; impersonate others; publish content that is unlawful, misleading or infringes third-party rights; collect data about people without a lawful basis; attempt to access other accounts or the systems behind the service; or overload or interfere with the service. We may suspend or remove accounts or content that breach these terms.
Phone numbers. You may only register a WhatsApp number that is yours or that its owner has authorised you to use. If someone used your number without your permission, write to [email protected]; we will remove the number from every account and block it from being registered again.
7. Your content and your clients' data
You keep ownership of the content you upload. You give us a limited, non-exclusive licence to host, display and back up it as needed to run your page and the service.
For the personal data of your clients that you receive through Gooingto (for example their name and appointment), you are the data controller and we are your processor. You are responsible for having a lawful basis, for informing your clients, and for answering their requests. Our processing on your behalf is governed by the Data Processing Addendum, which forms part of these terms. How we handle our own data is described in the Privacy Policy.
8. Third-party services
Gooingto relies on third parties, such as WhatsApp (which your clients use to confirm appointments), our payment provider and our email and hosting providers. Those services have their own terms and privacy policies and we are not responsible for them.
9. Our intellectual property
Gooingto, its logo, design and software belong to us or our licensors. Except for the rights expressly granted here, nothing transfers any right to you. Pages on the free plan display a "Made with Gooingto" mark that you may not remove.
10. Suspension and termination
We may suspend or terminate your access if you seriously or repeatedly breach these terms, if required by law, or to protect the service or other users. Where reasonable we will tell you first. On termination, your public page stops being available and your data is deleted as explained in the Privacy Policy.
11. Availability and warranties
We work to keep Gooingto available and reliable, but it is provided "as is" and we do not guarantee it will be uninterrupted or error-free. We are not responsible for appointments that are missed, double-booked or not confirmed as a result of interruptions, third-party outages or incorrect data entered by you or your clients.
12. Liability
To the maximum extent permitted by law, we are not liable for indirect or consequential losses, loss of profits, revenue or data. Our total liability for any claim relating to the service is limited to the fees you paid to us in the 12 months before the event that gave rise to the claim (or EUR 100 if you are on a free plan). Nothing in these terms limits liability that cannot be limited by law, including liability for wilful misconduct or gross negligence, or your statutory rights as a consumer.
13. Changes to these terms
We may update these terms. We will notify you of material changes by email or in the panel at least 30 days before they apply. If you keep using Gooingto after that date, you accept the new terms. If you do not agree, you can cancel before they apply.
14. Governing law and disputes
These terms are governed by the laws of Georgia. Any dispute will be submitted to the competent courts of Georgia, without prejudice to the mandatory rights that consumers have under the law and courts of their country of residence.
